This Privacy Policy (“Policy”) lets you know how Prenatal Yini, LLC (“Prenatal Yini”, “We, “Us” “Our”) collects and uses your (“Customer” “You” “User” or “Users” ) Personal Information, how you can control its use, and describes our practices regarding information collected from the website (“website”) and also from pregnancy and lactation services offering moms needing breastfeeding help. (“Services”).

This Privacy Policy applies to the website and all products and Services offered by Prenatal Yini.

We at Prenatal Yini know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways. 

Remember that your use of Prenatal Yini’s Services is at all times subject to the Terms of Use which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

The Services may provide links to or the ability to connect with non-Prenatal Yini websites, services, social networks or applications. Clicking on those links or enabling those connections might allow the third party to collect or share information about you. Those third-party websites or services are beyond Prenatal Yini’s control. Prenatal Yini advises you to check the privacy policies and terms of use of any non-Prenatal Yini websites or services before providing any of your Personal Information to them.

As noted in the Terms of Use, we do not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Services or send any personal information about yourself to us without the consent of a parent or legal guardian. If we learn that we have collected personal information from anyone under age 18 without consent, we will delete that information as quickly as possible. Will Prenatal Yini ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice in the app, by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. 

Personal and other additional information we collect about you

Through your interaction with and use of the website and Services, including signing up for the Services, Prenatal Yini may collect Personal Information, which is information that identifies an individual or relates to an identifiable individual. Personal Information may include, but is not limited to information such as your IP address, e-mail address, name, home or work address or telephone number, and referer, time and search inquiry.

In the course of providing Services to you, Prenatal Yini may have access to individually identifiable protected health information(“PHI”), as defined in 45 C.F.R. § 160.103, maintained by You that is protected as confidential under the Privacy Standards of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA Privacy Standards”) as amended from time to time. PHI includes your private, sensitive, personally identifiable information (PII) that you privately submit through the Services, including your medical and health information, medical and health information protected by HIPAA, and legal and financial information.

Prenatal Yini intends to comply, and for this Agreement to comply, with HIPAA and Subtitle D of Title XIII of the American Recovery and Reinvestment Act of 2009, known as the Health Information Technology for Economic and Clinical Health Act (“HITECH Act”)

By submitting (PII) through the Services, you hereby do and shall grant Prenatal Yini a worldwide, non-exclusive, royalty-free license to use and store your (PII) only in furtherance of providing the Services on your behalf, and subject to our Privacy Policy and Terms of Use.

Prenatal Yini may not use or further disclose PHI in a manner that would violate the HIPAA Privacy Standards or the HITECH Act. Prenatal Yini may use PHI for the proper management and administration of the Prenatal Yini Services to carry out the legal responsibilities of Prenatal Yini..

Prenatal Yini may disclose PHI if: (i) the disclosure is required by law, or (ii) Prenatal Yini obtains reasonable assurances from the person to whom the PHI is disclosed that the PHI will be held confidentially and not used or further disclosed, except for the purpose for which it was disclosed to the person, and the person notifies Prenatal Yini of any instances of which the person is aware in which the confidentiality of the PHI has been breached.

If in performing its obligations under this Agreement, Prenatal Yini, its employees, agents, subcontractors and any other individual permitted by Prenatal Yini will have access to certain computer systems, networks, files, data or software owned by or licensed to You that contain PHI, then Prenatal Yini shall implement administrative, technical and physical safeguards as necessary to protect the security, integrity, and confidentiality of all such computer systems, networks, files, data and software and any PHI contained therein.  In addition, Prenatal Yini will implement administrative, technical and physical security practices to maintain the integrity and confidentiality of electronically transmitted PHI.

Limitation on Use, Appropriate Safeguards. Prenatal Yini shall not use or further disclose PHI other than as permitted by this Agreement or as required by law and shall use appropriate safeguards to prevent use or disclosure of PHI other than as permitted by this Agreement or as required by law.

Report of Breach. Prenatal Yini shall report, in writing, to You any use or disclosure of PHI not permitted by this Agreement or the Privacy Standards within five (5) days of becoming aware of such inappropriate use or disclosure.  Prenatal Yini agrees to reasonably cooperate with you to investigate the cause and extent of such inappropriate use or disclosure of PHI.  You shall, upon receipt of notice, determine if notification of individuals impacted by such inappropriate use or disclosure is required.  If notification is required, You will be responsible for notifying the affected individuals, unless Prenatal Yini and You agree otherwise.  For any inappropriate use or disclosure of PHI resulting from the acts or omissions of Prenatal Yini, Prenatal Yini shall be responsible for all your costs and expenses to conduct an investigation and to notify affected individuals.  In addition, Prenatal Yini, at its expense, shall take all necessary and appropriate steps to mitigate the harm caused by any such inappropriate use or disclosure of PHI.  

Agents, Subcontractors. Prenatal Yini shall ensure that any agents, including any subcontractor, to whom it provides PHI received from or created or received by Prenatal Yini on behalf of You agree to the same restrictions and conditions that apply to Prenatal Yini with respect to such information.

Access to PHI. Within thirty (30) days of receiving a written request from You, Prenatal Yini shall make available PHI to individuals requesting it in accordance with 45 C.F.R. § 164.524.

Amendment to PHI. Within sixty (60) days of receiving a request from You, Prenatal Yini shall make available PHI for amendment and incorporate any amendments or corrections to PHI in accordance with 45 C.F.R. § 164.526.  

Accounting of PHI. Within thirty (30) days of receiving a written request from You, Prenatal Yini shall make available the information required to provide an accounting of disclosures or corrections in accordance with 45 C.F.R. § 164.528. Prenatal Yini shall also provide a monthly written report (due to You on or before the fifteenth day of the subsequent month) of any and all disclosures of PHI from You.  In the event no such disclosures occurred, no written report to You shall be required.  This monthly reporting shall facilitate Your ability to comply with requests for an accounting of disclosures.

Availability of Books and Records to Secretary. Prenatal Yini shall make its internal practices, books, and records relating to the use and disclosure of PHI received from, or created or received by Prenatal Yini on your behalf available to the Secretary of the United States Department of Health and Human Services for purposes of determining the Your compliance with the HIPAA Privacy Standards.

There is also information about your computer hardware and software that is automatically collected by Prenatal Yini. This information may include: your IP address, browser type, domain names, access times and referring Web site addresses. This information is used by Prenatal Yini for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Prenatal Yini Web site.

Prenatal Yini encourages you to review the privacy statements of Web sites you choose to link to from the Prenatal Yini website so that you can understand how those Web sites collect, use and share your information. Prenatal Yini is not responsible for the privacy statements or other content on Web sites outside of the Prenatal Yini and Prenatal Yini family of Web sites.

Use of your Personal Information.

Prenatal Yini collects and uses your personal information to operate the Prenatal Yini Web site and deliver the services you have requested. Prenatal Yini also uses your personally identifiable information to inform you of other products or services available from Prenatal Yini and its affiliates. Prenatal Yini may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Prenatal Yini does not sell, rent or lease its customer lists to third parties. Prenatal Yini may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. If your Personal Information appears on our blogs and you want it removed, contact us. If we are unable to remove your information, we will tell you why. If you write comments on our Blog it may collect personal information about you such as your name, e-mail address and URL. Our site also has a form which collects user’s names, e-mail addresses, telephone numbers and whatever remarks the user adds in the message field.

(b) Social media platforms and widgets. Our Websites may include social media features, such as the Facebook Like button. These features may collect information about your IP address and which page you are visiting on our Website, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. We may also maintain presences on social media platforms including Facebook, Twitter, and Instagram. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. (c) Links to third-party websites. Our Websites may include links to other websites, whose privacy practices may be different from Prenatal Yini . If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Website you visit.

Third Parties

We may disclose Personal Information to the following types of third parties for the purposes described in this policy:

(a) Service providers. Sometimes, we need to use third party Service Providers in order to provide and support the features of our Services. For example, if it is necessary to provide you something you have requested (like enable a feature), then we may share your Personal Information with a Service Provider for that purpose. We will tell you we are working with a Service Provider whenever reasonably possible, and you may request at any time the names of our Service Providers. Just like with the other third parties we work with, these third party Service Providers enter into a contract that requires them to use your Personal Information in a manner that is consistent with this policy.We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

(b) Advertising partners. We may partner with third parties to display advertising on our Websites or to manage our advertising on other sites and may share Personal Information with them for this purpose. All third parties with which we share this information enter into a contract with us that requires them to use your Personal Information in a manner that is consistent with this policy. We or our third party partners may use technologies, such as cookies, to gather information about your activities on our Websites and other sites in order to provide you with advertising based on your browsing activities and interests.

(c) Agents: We might employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. 

(d) User Profiles and Submissions: Certain user profile information, including your name, location, and any video or image content that such user has uploaded to the Services, may be displayed to other users to facilitate user interaction within the Services or address your request for our services. Your account privacy settings may allow you to limit the other users who can see the Personal Information in your user profile and/or what information in your user profile is visible to others. Please remember that any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. Your user name may also be displayed to other users if and when you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments. Additionally, if you sign into the Services through a third party social networking site or service, your list of “friends” from that site or service may be automatically imported to the Services. Again, we do not control the policies and practices of any other third party site or service.

Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of Personal Information, such as name, email and mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes and (b) the names and addresses of all such third parties. Special Rules For Children. Because of federal law, we are not permitted to knowingly collect any personal information from a child under the age of thirteen without the consent of that child’s parent or guardian. The statements in this Privacy Policy about our collection and use of personal information also apply to our treatment of personal information from children under the age of eighteen. Some elements of our Services such as signing up for our Services might require the submission of a payment card number along with personal information in connection with a purchase; other elements of our Services require the submission of personal information to access or use the Services. Except in certain cases where limited contact information may be collected and not retained, these elements of our Services are not available to children under the age of eighteen. If a child who we know to be under the age of eighteen and for whom we have not received parental consent attempts to utilize a service on our Services which is not available to children, he/she will not be able to access it and may receive a message which relays that he/she is not eligible for such feature.
